State by-election for the district of Upper Hunter 

The NSW Electoral Commissioner has been advised that the Member for Upper Hunter resigned from Parliament on Wednesday, 31 March 2021.

Under section 76(1) of the Electoral Act 2017, the writ to fill the vacancy is to be issued by the Speaker of the Legislative Assembly. 

The writ will contain:

  • the date of the writ,

  • the nomination day for the election,

  • the day for the taking of the poll for the election, if required (the election day),

  • the day by which the writ is to be returned to the Governor or Speaker, as the case requires (the return day).

Although the NSW Electoral Commissioner is responsible for administering state by-elections, the issuing of the writ and the timeframe for doing so is a matter for the Speaker of the Legislative Assembly.
