Who can be an agent?

To be appointed by a party, third-party campaigner or associated entity as an agent, a person must:

  • be enrolled to vote in New South Wales

  • successfully complete the NSW Electoral Commission's agent training program (unless exempt)

  • not have been sentenced to a term of imprisonment of 30 months or more

  • not have been convicted of an:

    • indictable offence

    • offence against the Electoral Funding Act 2018

    • electoral offence.

  • not have been convicted as an adult in the last 10 years of an offence involving fraud or dishonesty.

A party agent must also be a senior office holder of the party.

In some cases, a person may not be appointed as an agent but may be designated by the NSW Electoral Commission as an official agent. A registered officer of a party may be a party agent because the party has not appointed a party agent. In these cases, there is no criteria for a person to be a party agent or official agent.
