Challenge to Election Results
The validity of any election may be disputed by petition addressed to the Court of Disputed Returns. The Supreme Court is the Court of Disputed Returns.
If a candidate considers that an irregularity could have altered the result of the election then they can take the matter to the Court of Disputed Returns for investigation.
A petition to the Court of Disputed Returns must be signed by a candidate at the election in dispute or by a person who was qualified to vote at the election. The petition must also be signed by two witnesses.
If the Court of Disputed Returns holds that the result of the election was affected by any irregularity then it has the power to (among other things):
- declare that any person who was elected was not duly elected
- declare any candidate duly elected who was not returned as elected or
- declare any election absolutely void.
