You must register as a candidate before you accept political donations or make payments for electoral expenditure. Registration is separate to being nominated as a candidate for the By-election (see step 4).

For a State By-election, candidate registration starts on the day the writ is issued.

Candidate registrations are open until 12 noon on nomination day.

Every candidate must have an official agent.

If you are not a member of a registered political party you must appoint an official agent and notify the NSWEC. You must appoint your agent when you register for the By-election. If you do not register, you must appoint your agent when nominating for the By-election.

If you are a member of a registered political party, the party agent of that political party is your official agent. You do not need to appoint an official agent unless you want a different person to be your agent. You must have the party agent’s consent to appoint a different person as your agent.

Official agents are responsible for managing the political donations and electoral expenditure of candidates. There are strict legal requirements for political donations and electoral expenditure that must be complied with.

All electoral material (how to votes) that is to be distributed on Election Day by registered political parties, groups, candidates, and any other person or organisation must be registered with and approved by the Electoral Commissioner.

It is an offence to distribute electoral material on the By-election day unless the material has been registered by the Electoral Commissioner. 'Distribution' also means the placement of electoral material that can be collected by electors.

Applications to Register Electoral Material along with one copy of each item to be registered, must be lodged online through the Registration of Electoral Material System between Nomination Day to 5.00pm on the Friday, 8 days prior to Election Day.
